Your minimum holiday rights and how to enforce them
Holidays Act 2003, ss 6, 75, 76
The holiday entitlements guaranteed to you by the Holidays Act 2003 and explained in this section are your minimum rights – you and your employer can agree on additional or better holiday conditions.
If your employer hasn’t given you your minimum holiday entitlements, you can contact a labour inspector for help. You or the labour inspector can apply to the Employment Relations Authority for it to order your employer to pay a monetary penalty. If the Authority decides to do this, it can order the penalty to be paid to you.
