Criminal legal aid
What happens if criminal legal aid isn’t granted
How will I know if I’ve been refused criminal legal aid?
Legal Services Act 2011, ss 17, 51, 52
The Legal Services Commissioner must inform the applicant, in writing, if their application for criminal legal aid is unsuccessful. Applicants have the right to ask the commissioner to reconsider the decision. If that doesn’t change the decision, they can then apply to the Legal Aid Tribunal for a review of the decision. (See below, “Challenging a criminal legal aid decision”.)
