Mental health
The compulsory assessment process
Step 7: The certificate of final assessment
Mental Health (Compulsory Assessment and Treatment) Act 1992, s 14
During the second period of assessment, your responsible clinician has to examine you again and provide a certificate of final assessment that says whether or not they believe you are fit to be released from “compulsory status”.
If the responsible clinician decides that you are fit to be released, you don’t have to receive any further treatment under the Mental Health Act (but this does not prevent another application to have you assessed under the Mental Health Act being made in the future). If the responsible clinician decides that you are not fit to be released, they must apply for a compulsory treatment order.
